Expert Views on ADR (EVA) Vid /Podcast Show Quotes January 2024

‘The term adjudication may be confusing because adjudication generally refers to the process of deciding a case or resolving a dispute. Nonetheless, in reference to alternative dispute resolution is an adjudication process that involves the resolution of a dispute
between parties by a neutral third party known as an adjudicator, who is an expert in the subject matter of the dispute; the decision of the adjudicator is binding until or unless it is revised.’

What ADR Book are you Reading? We’re Here to Help When Guardianship Goes Wrong

What ADR Book are you reading?

Pour moi-meme, I look forward to reading and reviewing the intriguing researched book ‘We’re Here to Help when Guardianship Goes Wrong’ by the award-winning investigative journalist and author Diane Dimond.

Excerpts from the Book’s Synopsis

‘The book examined the troubling concerns surrounding the guardianship/conservatorship system and its mishandling by the American legal system.’ “The state-run guardianship system, called conservatorship in some states, is largely unregulated, ill-understood, and increasingly populated by financially motivated predators. Just how the secretive world of guardianship works and its real-life effects remained a mystery to most until the very public case of pop star Britney Spears. It suddenly became clear that those conscripted into the system lose all their civil rights in the process. Currently, there are an estimated 1.5 to 2 million Americans under court control, but precise figures are not known as no government entity keeps track of citizens who have lost the right to determine their own fate.

Established in the late 1800s, the guardianship system was designed to assist the most vulnerable citizens: the elderly and the physically or intellectually disabled.”

Thought-provoking. Right? The first question that came to mind when I read the book’s synopsis was, ‘Can ( Appropriate / Alternative Dispute Resolution) provide a viable reform solution’?

You can share in the comment section, ‘What ADR book are you reading or looking forward to reading?’ Let us continue the conversation and spread the much-needed awareness about the benefits of Appropriate Dispute Resolution (ADR).

Author’s Bio

Dimond may be best known for breaking the story of child molestation allegations against singer Michael Jackson in late 1993 and again in 2003 and following the story through the entertainer’s criminal trial in 2005-Dimond’s book, “Be Careful Who You Love: Inside the Michael Jackson Case.”

The Magic in Mediation: A Search for Symmetries, Metaphors and Scale-Free Practices- By Professor Kenneth Cloke

#expertviewsonadrvidpodcastshow #whatadrbookareyoureading #kencloke
Anyone who has mediated is likely to have experienced the magic of mediation and would very much like to do so again. But if asked where this magic came from, how it happened, what it consisted of, and how they might replicate it, most would be hard pressed to answer.
To identify the sources of magic in mediation, we need to learn by metaphor from other disciplines and professions and search for ways of translating successful small-scale techniques into scale-free methodologies that can be applied to mid- and large-scale conflicts. We are actively creating wars, pandemics, and environmental conflicts that cannot be resolved or prevented except globally, collaboratively, and meditatively, using scaled-up, higher order dispute resolution skills. This is the core mission and calling of conflict resolvers around the world. And as these problems and conflicts have no borders, neither should our efforts to resolve them.
Magic happens not only because of what we do, but who we are; in spite of everything the parties have said and done to each other, all their anguish and pain and trauma and loss, all their failed efforts and hopelessness. Why? Because we know, in our minds and hearts that magic is possible, and are ready to step into their hatred and fear and darkness and uncertainty, to search for it there. In mediation, we allow ourselves, for a moment, to become the magic they are seeking, merely because they do not yet understand that the magic is already inside and between them.

What ADR Book are you reading?‘Rising Above Office Conflict A Light-Hearted Guide for the Heavy-Hearted Employee.’

@Expert Views on ADR (EVA) Vid /Podcast presents #What ADR Book are you reading?

The idea behind this initiative is to encourage ADR Advocates, enthusiasts, practitioners and users or potential users of ADR to share ADR books they are reading or have read. The aim is to raise awareness of the benefits of utilising ADR to settle conflicts and disputes and make it a more widely recognised and utilised practice.

Currently, I am reading Professor Clare E Fowler’s ADR Book ‘Rising Above Office Conflict A Light-Hearted Guide for the Heavy-Hearted Employee.’

Excerpts from the book:

ANGRY ESCALATIONS

Most initial interactions, even with an angry person, are fairly benign. The problem with conflicts is when they escalate.

Let’s say you ask the new intern to grab more creamer for the office kitchen. He comes in the next day with almond milk creamer, and you wanted half-half.  Not a big deal, right? You let him know, and the next day he grabs half-half.  Now you have what you need to make your coffee taste like not-coffee.

But then, he does it again. He comes in with almond milk creamer! Now, clearly, the intern has disregarded your request on purpose.

What an insolent, entitled little snot. You extended him mercy the first time? Let your wrath rain down!

This could be a simple little conflict, right? Ask him why, and maybe tells you that the rest of the staff appreciated the almond milk creamer. Maybe he actually bought both types. Or maybe he is really just dim and forgot. This could be a simple conflict resolved with simple conversation.

But it escalated. You felt like your wishes were ignored.”

I must say that Professor Clare Fowler’s book is an absolutely indispensable resource for anyone seeking practical solutions to address workplace conflicts or disputes such as discrimination, bullying, and harassment. The insights and strategies presented within the pages of this book are universally applicable and can help prevent conflicts from escalating or effectively resolve those that have already done so. Employers who have not established an ombuds role are encouraged to get this book. From personal experience, I confidently endorse or recommend it as an effective tool for tackling workplace conflicts head-on.

So, what ADR book are you reading or have read? Have you encountered any exciting excerpts or quotes from an ADR book you would like to share? Let us continue the conversation and spread awareness about the importance of Appropriate Dispute Resolution!

With my Nigerian accent (lol), Grab your copy now from Amazon! And with my not-so-British accent, Do not hesitate to get hold of this book on Amazon! And in an American accent, “This book is awesome, You all! Don’t miss out – grab your copy from Amazon!”

I look forward to hearing your insights!

Expert Views on ADR (EVA) vid /podcast show Nov 2023 Quotes with Mediate.com

Expert Views on ADR (EVA) vid /podcast show Nov 2023 Quotes with Prof Clare Fowler, Colin Rule and Dr Ron Dolin, renowned ADR experts that built up the world’s leading mediation website and organization- Mediate.com
‘When I first started working in the mediation industry around 20-25 years ago, the entire process used to be extremely time-consuming and tedious. I had to spend countless hours sending letters back and forth, typing out documents, and travelling to the post office to mail them. However, with the incorporation of cutting-edge technology, we have now been able to streamline these tasks and focus more on the actual mediation process. This has made the entire process faster and more efficient, allowing us to get to where the magic happens faster.’- Professor Clare Fowler (Vice-Presdient Mediate.com and President of Fowler Mediation).
‘Society is rapidly transitioning into a digital age, and the world is becoming more interconnected. We can use the tools of technology. Professor Frank Sander, a pioneer in the field, could not have imagined what we can do now with artificial intelligence (AI) and mediate.com’ -Colin Rule (CEO of Mediate.com, Odr.com and Arbitrate.com; the 2023 recipient of the D’Alemberte / Raven Award American Bar Association Dispute Resolution). “If all we cared about was efficiency, we would resolve disputes with a coin toss”- Dr Ron Dolin (Chief Innovation Officer for Odr.com and Harvard Law Lecturer /Senior Research Fellow).
