Expert Views on ADR (EVA) Vid /Podcast Show Quotes April 2024

As we approach the end of April, I want to remind #potentialusers of the many reasons why they should opt for or consider ‘Traditional African Methods of Settling Disputes’ or the ‘Appropriate Dispute Resolution (ADR).’

The Expert Views on ADR (EVA) Vid / Podcast Show April 2024 quotes features a quote from the pioneer director of the Oyo State Multi-Door Courthouse, Mrs Anuolu Gade, in (2021) Episode 17: Oyo State Multi-Door Courthouse (OYSMDC) as it stands today -Under the Leadership of Mrs Anuolu Gade encapsulates some of these reasons-

‘In Nigeria, litigation can be a frustrating experience that often leaves litigants financially drained. However, the Oyo State Multi-Door Courthouse (OYSMDC) offers a user-friendly ADR mechanism that is quick, inexpensive, and helps build and preserve relationships.

As the Yoruba saying goes, “You do not go to court and come back as friends; you end up as permanent enemies.”

The OYSMDC offers several benefits, including enhancing businesses in the state in a short time. When people bring their cases to the centre, they can expect to resolve their disputes amicably within one or two sessions’- Mrs Anuolu Gade, the Director of the OYSMDC On The EVA Show 2021.

I was privileged to engage in a stimulating and thought-provoking conversation with Megan Willoughby on Expert Views on ADR (EVA) Vid / Podcast Show. She is serving as the first faculty Ombudsperson for Villanova University. She is their confidential consultant for work-related conflicts. In 2021, the American Bar Association (ABA) awarded her a Dispute Resolution Fellowship to hone her expertise in collaborative resolution. Meg is currently the Co-Chair of the Ombuds Committee in the Dispute Resolution Section of the American Bar Association. She is an Attorney and served as a Subject Matter Expert in the Office for Civil Rights, U.S. Department of Education, where she enforced federal civil rights statutes in schools that received federal funding, from Pre-K through # Ph.D. #programs .

She wears many hats, so I have left the link to her profile below:   / meganpwilloughby

In this series, we provided a comprehensive examination of the concept of ombuds and its history in various jurisdictions likeTurkey and Sweden, amongst others. Meg, a key contributor to the drafting of Resolution 500, revealed a detailed history of Resolution 500 and its recent adoption by the ABA House of Delegates.

The resolution strongly recommends ‘the use of Early Dispute Resolution (EDR), which consists of non-adjudicative methods for resolving disputes in a cost-effective and timely manner. These methods include direct negotiation, ombuds and mediation.’

In addition, we delved into the different types of ombuds, analysing the measurable differences in cost and time compared to litigation and other Appropriate Dispute Resolution (ADR) processes. Meg shed light on the role and independence of the ombudsman in conflict resolution and the pros and cons associated with this process. She also explored the scope of matters that can be resolved via ombuds, examining its role in #institutions, #organisations, #highereducation and #healthcare .

We provided examples of when an #ombudsman or #ombudsperson can maintain #confidentiality, as well as situations when this may not apply or exceptions to this general rule. We also covered the qualifications required to become an ombuds and the future of Mass Advocacy of ADR. Additionally, we discussed the potential for international legal research through podcasting, specifically in the realm of ADR-Ombuds. In conclusion, Meg shared insights on how members of the public/individuals can join the American Bar Association (ABA) Dispute Resolution and the benefits associated with it.
