I was privileged to engage in a stimulating and thought-provoking conversation with Megan Willoughby on Expert Views on ADR (EVA) Vid / Podcast Show. She is serving as the first faculty Ombudsperson for Villanova University. She is their confidential consultant for work-related conflicts. In 2021, the American Bar Association (ABA) awarded her a Dispute Resolution Fellowship to hone her expertise in collaborative resolution. Meg is currently the Co-Chair of the Ombuds Committee in the Dispute Resolution Section of the American Bar Association. She is an Attorney and served as a Subject Matter Expert in the Office for Civil Rights, U.S. Department of Education, where she enforced federal civil rights statutes in schools that received federal funding, from Pre-K through # Ph.D. #programs .

She wears many hats, so I have left the link to her profile below:   / meganpwilloughby

In this series, we provided a comprehensive examination of the concept of ombuds and its history in various jurisdictions likeTurkey and Sweden, amongst others. Meg, a key contributor to the drafting of Resolution 500, revealed a detailed history of Resolution 500 and its recent adoption by the ABA House of Delegates.

The resolution strongly recommends ‘the use of Early Dispute Resolution (EDR), which consists of non-adjudicative methods for resolving disputes in a cost-effective and timely manner. These methods include direct negotiation, ombuds and mediation.’

In addition, we delved into the different types of ombuds, analysing the measurable differences in cost and time compared to litigation and other Appropriate Dispute Resolution (ADR) processes. Meg shed light on the role and independence of the ombudsman in conflict resolution and the pros and cons associated with this process. She also explored the scope of matters that can be resolved via ombuds, examining its role in #institutions, #organisations, #highereducation and #healthcare .

We provided examples of when an #ombudsman or #ombudsperson can maintain #confidentiality, as well as situations when this may not apply or exceptions to this general rule. We also covered the qualifications required to become an ombuds and the future of Mass Advocacy of ADR. Additionally, we discussed the potential for international legal research through podcasting, specifically in the realm of ADR-Ombuds. In conclusion, Meg shared insights on how members of the public/individuals can join the American Bar Association (ABA) Dispute Resolution and the benefits associated with it.

The Adoption of Resolution 500-American Bar Association (ABA) House of Delegates

On February 5, 2024, during the ABA Mid-Year Meeting held in Louisville, Kentucky, the ABA House of Delegates unanimously approved Resolution 500, which strongly urges the increased use of Early Dispute Resolution (EDR).

Resolution 500 states: “RESOLVED, that The American Bar Association (ABA) urges lawyers and all interested parties to increase the informed and voluntary use of EDR: party-directed, non-adjudicative approaches to resolving disputes in a time-efficient and cost-effective manner, including, but not limited to, direct negotiation, mediation, and ombuds.”

It is imperative to state that the EDR Committee acknowledges the support of former EDR Committee Co-Chair and ABA Dispute Resolution (DR) Section current Council member Mary Cullen and ABA Ombuds Committee Co-Chair Meg Willoughby, who worked with Ellie Vilendrer and Felicia Harris Hoss, the current co-chairs of EDR, in drafting the Resolution and supporting the Report.

Furthermore, they appreciate the current ABA DR Section Chair Ana Sambold, Past DR Section Chairs and current Delegates David Larson and James Alfini, DR Section Director Jennifer Michel, Past DR Section Chair Myra Selby, and Merril Hirsh for their sound guidance and support.

Finally, the Committee is thrilled to have worked alongside the Resolution’s Co-Sponsors, the ABA Section of State and Local Government and ABA Senior Lawyers Division, and to have earned the support of the following: ABA Business Law Section, ABA Section of Labor and Employment Law, ABA Young Lawyers Division, and ABA Section of Government and Public Sector Lawyers.

What ADR Book Are You Reading? The Magic in Mediation: A Book by Ken Cloke -Quotes February 2024 By EVA

“Anyone who has mediated even a few disputes is likely to have experienced magic in mediation and would very much like to do so again. But if asked where this magic came from, how it happened, what it consisted of, and how they might replicate it, most would be hard-pressed to answer.

These unanswered questions, of course, form part of what makes any experience feel magical. But they are also the beginning of all arts and sciences. If we want to explore the magic in mediation more deeply, or explain the “fuzzy logic” that turns conflict into resolution, or consciously replicate these moving experiences, we need to unfold, unpack, dissect, and demystify the “miracles” of resolution we experience in mediation, hopefully without cancelling, mangling, or eviscerating them in the process. By magic, I do not mean illusion, trickery, sleight-of-hand, or superstition, but the very real, unpredictable metamorphosis of impasse into resolution.”
