I was privileged to engage in a stimulating and thought-provoking conversation with Ana Sambold, Esq, the Chair of the American Bar Association (ABA) Section of Dispute Resolution for the 2023-2024 Bar Year on Expert Views on ADR (EVA) Vid / Podcast show. Ana Sambold is a California attorney, mediator, and arbitrator and one of the leading figures in the field of dispute resolution in the world. With over a decade of experience, she has served as a neutral in over 1,000 cases across a broad spectrum of civil litigation matters.

She is also a Negotiation Professor at the University of San Diego School of Law and has taught extensively in conflict resolution, negotiation, and ADR globally. She is fully bilingual (English/Spanish) enabling her to effectively mediate and teach in both languages. Ana has also served as the Chair of the San Diego County Bar Association ADR Section, Co-Chair of the California Lawyers Association ADR Committee, and President of the San Diego Law Library Foundation, among other leadership roles.

She wears many hats, so I have left the links to her profile below:

In this series, Ana provided a comprehensive overview of what led to the establishment of the American Bar Association Section of Dispute Resolution. She then delved into the Section’s role and functions, highlighting how it serves the broader community.

Additionally, Ana touched on the Section’s efforts to promote diversity and inclusivity and the benefits they have yielded. One notable effort is the approval of Resolution 105 in 2018 by the ABA House of Delegates, which aimed to increase diversity in dispute resolution. We also examined some of the Section’s significant achievements within the larger context of the organisation. These achievements include Resolution 500, which strongly urges increased use of Early Dispute Resolution (EDR), while Resolution 703 approved the Uniform Collaborative Law Rules and Uniform Collaborative Law Act (UCLA) and Resolution 501, which underscores the principle of Civility as the cornerstone of democracy and the rule of law.

Ana went on to provide a detailed outline of the new programmes available at the upcoming 2024 Dispute Resolution Spring Conference, which will be held from April 10th to 13th in San Diego, California. Finally, Ana elaborated on the perks of being an American Bar Association (ABA) Dispute Resolution Section member.

What ADR Book are you Reading? We’re Here to Help When Guardianship Goes Wrong

What ADR Book are you reading?

Pour moi-meme, I look forward to reading and reviewing the intriguing researched book ‘We’re Here to Help when Guardianship Goes Wrong’ by the award-winning investigative journalist and author Diane Dimond.

Excerpts from the Book’s Synopsis

‘The book examined the troubling concerns surrounding the guardianship/conservatorship system and its mishandling by the American legal system.’ “The state-run guardianship system, called conservatorship in some states, is largely unregulated, ill-understood, and increasingly populated by financially motivated predators. Just how the secretive world of guardianship works and its real-life effects remained a mystery to most until the very public case of pop star Britney Spears. It suddenly became clear that those conscripted into the system lose all their civil rights in the process. Currently, there are an estimated 1.5 to 2 million Americans under court control, but precise figures are not known as no government entity keeps track of citizens who have lost the right to determine their own fate.

Established in the late 1800s, the guardianship system was designed to assist the most vulnerable citizens: the elderly and the physically or intellectually disabled.”

Thought-provoking. Right? The first question that came to mind when I read the book’s synopsis was, ‘Can ( Appropriate / Alternative Dispute Resolution) provide a viable reform solution’?

You can share in the comment section, ‘What ADR book are you reading or looking forward to reading?’ Let us continue the conversation and spread the much-needed awareness about the benefits of Appropriate Dispute Resolution (ADR).

Author’s Bio

Dimond may be best known for breaking the story of child molestation allegations against singer Michael Jackson in late 1993 and again in 2003 and following the story through the entertainer’s criminal trial in 2005-Dimond’s book, “Be Careful Who You Love: Inside the Michael Jackson Case.”

What ADR Book are you reading?‘Rising Above Office Conflict A Light-Hearted Guide for the Heavy-Hearted Employee.’

@Expert Views on ADR (EVA) Vid /Podcast presents #What ADR Book are you reading?

The idea behind this initiative is to encourage ADR Advocates, enthusiasts, practitioners and users or potential users of ADR to share ADR books they are reading or have read. The aim is to raise awareness of the benefits of utilising ADR to settle conflicts and disputes and make it a more widely recognised and utilised practice.

Currently, I am reading Professor Clare E Fowler’s ADR Book ‘Rising Above Office Conflict A Light-Hearted Guide for the Heavy-Hearted Employee.’

Excerpts from the book:

ANGRY ESCALATIONS

Most initial interactions, even with an angry person, are fairly benign. The problem with conflicts is when they escalate.

Let’s say you ask the new intern to grab more creamer for the office kitchen. He comes in the next day with almond milk creamer, and you wanted half-half.  Not a big deal, right? You let him know, and the next day he grabs half-half.  Now you have what you need to make your coffee taste like not-coffee.

But then, he does it again. He comes in with almond milk creamer! Now, clearly, the intern has disregarded your request on purpose.

What an insolent, entitled little snot. You extended him mercy the first time? Let your wrath rain down!

This could be a simple little conflict, right? Ask him why, and maybe tells you that the rest of the staff appreciated the almond milk creamer. Maybe he actually bought both types. Or maybe he is really just dim and forgot. This could be a simple conflict resolved with simple conversation.

But it escalated. You felt like your wishes were ignored.”

I must say that Professor Clare Fowler’s book is an absolutely indispensable resource for anyone seeking practical solutions to address workplace conflicts or disputes such as discrimination, bullying, and harassment. The insights and strategies presented within the pages of this book are universally applicable and can help prevent conflicts from escalating or effectively resolve those that have already done so. Employers who have not established an ombuds role are encouraged to get this book. From personal experience, I confidently endorse or recommend it as an effective tool for tackling workplace conflicts head-on.

So, what ADR book are you reading or have read? Have you encountered any exciting excerpts or quotes from an ADR book you would like to share? Let us continue the conversation and spread awareness about the importance of Appropriate Dispute Resolution!

With my Nigerian accent (lol), Grab your copy now from Amazon! And with my not-so-British accent, Do not hesitate to get hold of this book on Amazon! And in an American accent, “This book is awesome, You all! Don’t miss out – grab your copy from Amazon!”

It’s a wrap! Incredible session with Dr Anita Dorczak #happythanksgiving

It’s a wrap! I had an incredible podcast session with one of my favourite mentors from the American Bar Association (ABA) Section of Dispute Resolution, the intelligent and amiable Dr Anita Dorczak. I am grateful to have had this opportunity, and it was a highly productive and enlightening conversation.

We thoroughly analysed how collaborative law has significantly impacted access to justice in Canada. We also explored the future of legal research through podcasting, with a strong focus on Appropriate/Alternative Dispute Resolution, amongst other questions.

Dr. Anita really caught me off guard! (She asked me a question) I can’t wait to share this episode! Have a super chill Thanksgiving; make sure to eat lots of good food and enjoy time with your loved ones!

I appreciate your support through subscribing, sharing, and downloading each episode. It means a lot to me.

The aim is to raise awareness of the benefits of utilising ADR to settle conflicts and disputes and make it a more widely recognised and utilised practice.

So, I am curious: what ADR book are you reading or have read? As for me, I am reading ⁦‪@Professor Kenneth Cloke titled ‘The Crossroads of Conflict A Journey into the Heart of Dispute Resolution.’

So far, It’s a truly transformative book that has reshaped how I think about conflict. The way Prof. Kenneth Cloke explores the topic is nothing short of magical and healing. I highly recommend it. More reviews on this book coming soon! #Grab a copy @Amazon.

Excerpts from the book: “Every conflict we experience, no matter how trivial, points us toward a crossroads in our lives. One path leads us to into anger, fear, confrontation and bitterness and draws us into quarrels over the past. This path reveals a deep level of caring about outcomes yet also encourages adversarial relationships, sterile communications, contemptuous ideas, negative emotions and unpleasant physical sensations, blinding us and dissipating our energy and spirit. This is the path of impasse, aggression, and antagonism.”
