The Adoption of Resolution 703 By the American Bar Association (ABA) House of Delegates

 

On the 5th of February 2024, the American Bar Association (ABA) House of Delegates adopted Resolution 703. The Resolution reads:

RESOLVED, that the American Bar Association approves the Uniform Collaborative Law Rules and Uniform Collaborative Law Act (UCLA), promulgated by the National Conference of Commissioners on Uniform State Laws in 2010, as appropriate Rules or an appropriate Act for those states desiring to adopt the specific substantive law suggested therein.
Currently, nearly half of the US states have adopted the Act formalising the collaborative process. #Missouri and #Kentucky are currently considering adopting the UCLA this year.
Thanks to Professor Kristen Blankley (President of Global Collaborative Law Council Inc (GCLC), the late Kevin Scudder (founder of the Seattle Collaborative Law Center), Ana Sambold, Esq. (Chair, American Bar Association (ABA)-Dispute Resolution (DR), Susan Guthrie (Chair-elect, ABA-DR), Dean James Alfini, the ABA Section of Dispute Resolution, Harry L Tindall, Robert Merlin, Cole Jeffries, and all the other leaders who have pushed for the adoption of the UCLA, not only in the US but also globally through efforts of members of the International Academy of Collaborative Professionals (IACP) and the Global Collaborative Law Council Inc (GCLC).

Ms. Patterson has extensive experience in software development, product management, and proposal development. She has been featured in the Association for Conflict Resolution’s ACResolution magazine for her Alternative Dispute Resolution work as well as in the United Nations Association of United States Interdependent magazine, Rolling Out magazine, the George Washington University’s Center for Excellence in Public Leadership newsletter for her community service work, and the United States Geo-spatial Intelligence Foundation’s Trajectory magazine for her work with Jade Solutions.

She is a Professor of Law at the University of Nebraska and an adjunct/Affiliated Professor at Mitchell Hamline School of Law.

Professor Blankley researches in the areas of alternative dispute resolution, legal ethics, and the intersection of ethics and dispute resolution. She teaches Alternative Dispute Resolution, Advocacy in Mediation, Mediation, Family Mediation, Arbitration, Facilitation, and Legal Professions. She also coaches students in mediation competitions.

Professor Blankley is involved in ADR policy within Nebraska and as well as nationwide initiatives.  She was appointed a member of the American Bar Association (ABA) Section of Dispute Resolution Council in 2016 and chairs the Section on Ethics. She has been involved in developing ethics policies and standards in the areas of mediation & restorative justice.

It was an honour having Professor Kevin Scudder as a guest on Expert Views on ADR (EVA) vid/podcast Show; he was a good listener, down-to-earth, empathetic, intelligent, kind and an incredible teacher with a keen eye for detail-“Chinwe, I noticed you don’t have Collaborative law on your slide as one of the dispute resolution processes.”

I have added Collaborative Law as one of the Appropriate methods of settling disputes to my slide and my podcast channel, and I use appropriate instead of alternative. Of course, Kevin is passionate about peacebuilding and was willing to share everything he knew about Collaborative law within thirty (30) mins. I was privileged to attend your training/ seminar American Bar Association Dispute Resolution conference in May in #lasvegas. I learned much about the two things you love -collaborative law and your family. You connected the two perfectly well.

Your passion for collaborative law practice was truly inspiring. Your dedication to promoting peace and cooperation through collaborative law practice will not be forgotten.

Thank you for contributing to making the world a better place through peacemaking. Thank you for being so passionate about ADR, for your kindness and for coming on the show in a short amount of time and making it so easy for me to be myself and ask relevant follow-up questions.
