ADR and Arbitration: a UK Perspective with Ijeoma Ononogbu, FCIArb (Video /Podcast)

I was privileged to engage in a stimulating and thought-provoking podcast session with  Ijeoma Ononogbu on Expert Views on ADR (EVA) Vid /Podcast Show. Ms Ononogbu has over fifteen (15) years of international legal experience from working with international law firms in London as a solicitor, specialising in commercial transactions and ADR processes in private practice. She serves as a CIArb Business Arbitration Scheme panel member.

In this episode, we analysed the concept of arbitration, its types and key features. We delved into the various types of disputes that can be resolved through arbitration and examined the issue of corruption within arbitration. We also explored how arbitration has enhanced access to justice in the UK. This includes the initiatives of arbitral institutions to promote diversity, equity, and inclusion (DEI) and tackle cybersecurity concerns.

Furthermore, we highlighted the impact of third-party funding on access to justice and the efficiency of settling disputes through arbitration compared to litigation. We also discussed the recently amended rules of the arbitral institutions aimed at enhancing the effectiveness of arbitration. Finally, Ije highlighted the positive career opportunities in the field of arbitration.

 Looking forward to the podcast session with Professor Maria Volpe, PhD, on Expert Views on ADR (EVA) Vid / Podcast Show. She is a professor of Sociology, Director of the Dispute Resolution Program at John Jay College of Criminal Justice – City University of New York, and Director of the CUNY Dispute Resolution Center, a university-wide center focusing on dispute resolution research and innovative program development.
 An internationally known scholar, Prof. Volpe has lectured, researched, and written extensively about dispute resolution processes, particularly mediation, and has been widely recognized for her distinguished career in the field of dispute resolution, including the 2008 Lawrence Cooke Peace Innovator Award, 2008 Network for Peace Recognition, 2010 Association for Conflict Resolution of Greater New York Achievement Award, 2011 Frontline Champion Award, 2013 FamilyKind Recognition, 2014 Faculty Advisor of the Year, amongst  others.
In addition to teaching and research, she mediates conflicts in educational settings, conducts dispute resolution skills training, administers grant-funded projects, and facilitates for a wide range of groups. At John Jay College, she has created and facilitated town meetings, cops and kids dialogues, Muslim/Non-Muslim student dialogues, Black Jewish Dialogues, intergenerational dialogues, and Asian American student discussions. Since 9/11, she initiated the NYC-DR listserv, the monthly NYC-DR Roundtable Breakfast, and a variety of dispute resolution public awareness initiatives.

Finding ‘Pride in ADR’

Let’s keep in mind the importance of Diversity, Equity, and Inclusion (DEI)-which encompasses policies and practices to foster an inclusive environment where individuals from diverse backgrounds feel valued and welcomed.

It is imperative to state that many companies, organisations, and institutions have proactively implemented programs to promote diverse, equitable, and inclusive workplaces. While significant progress has been made for women and underrepresented groups /ethnicities, I believe there is still work to be done to advance the representation and inclusion of disabled individuals and the LGBTQIA community.

The irony of DEI is that despite significant theoretical progress, practical implementation still presents challenges; as a result, it is imperative to actively promote events focused on DEI, specifically involving the LGBTQIA community, to drive advancements in this critical area.

The Federal Bar Association (FBA) Alternative Dispute Resolution has courageously taken a bold step by organising the first-ever ‘Pride in ADR event.’ I look forward to attending this event because ADR is for everyone, and no one should be excluded!

During my time in Hamtramck, I had the privilege of participating in a stimulating and thought-provoking podcast with Dwydell Garrett, the son of Sarah Sims Garrett. He shared with me the details of a landmark case that lasted over five (5) decades, from 1968 to 2024 – the case of Sarah Sims Garrett et al. v City of Hamtramck. The case has far-reaching implications for housing disputes in the US and highlights the resilience of the Garrett family and others involved in the class action. It also raises the question of whether appropriate or alternative dispute resolution (ADR) through mediation could have expedited the case’s resolution.

Dwydell——–I believe this case has resulted in a fairer outcome for low-income individuals. It seems that many companies take advantage of the lower class to benefit the wealthier class. However, the community and its people are essential for the city to thrive. They pay taxes and water bills, and without them, the city cannot function. It’s crucial to provide housing for the community, and small corner stores are also important as not everyone can easily access larger stores. Therefore, it is vital to support and maintain our community stores to keep our community thriving.
