I was privileged to engage in a stimulating and thought-provoking podcast session with Dr Ben Hayward on Expert Views on ADR (EVA) Vid /Podcast Show. He is an Associate Professor in the Department of Business Law and Taxation at Monash Business School, Monash University, and an Australian lawyer admitted to practice in the Supreme Court of Victoria.
Dr Hayward has published on private and public law topics in Australian and international journals and presented his research at conferences in Australia and abroad. He has also given guest lectures on topics related to his teaching and research interests at Australian universities and was recognised by the Monash Business School’s 2020 Dean’s Award for Excellence in Research by an Early Career Researcher.
Dr. Hayward is currently the General Editor of The Australian Centre International Commercial Arbitration (ICA) Review, a biannual publication of the ACICA- Australian Centre for International Commercial.

In this episode, we analysed the concept of arbitration, its types, and key features. We delved into the various types of disputes that can be resolved through arbitration, such as energy disputes. We also explored how arbitration has enhanced access to justice in Australia. This includes the initiatives of the Australian Arbitral bodies/institutions to promote diversity, equity, and inclusion (DEI) and tackle cybersecurity concerns. Furthermore, we highlighted the impact of third-party funding on access to justice and the efficiency of settling disputes through arbitration compared to litigation. We also enumerated the many benefits of legal research in Arbitration via Educational /research podcasts while discussing the recently amended Australian Arbitration rules.
