‘When someone is placed under guardianship, it means that someone has submitted a petition to the court explaining why the person needs protection. In most cases, these petitions are approved, and the guardianship process begins.
The person under guardianship is referred to as an incapacitated ward of the court, and all their assets are placed under the court’s control. This includes their property, investments, land, homes, cars, art collection, and more, which are all put into the name of the appointed guardian.
In the US, state courts are responsible for confiscating approximately $50 billion worth of assets each year through guardianship and conservatorship processes.
Since the average guardianship or conservatorship lasts around six years, this represents a significant sum of around $300 billion that is under the control of others at any given time’-Diane Dimond.
