She is a thought leader in workplace bullying and serves as the Vice Chair of Programming for the Diversity Committee of the American Bar Association Dispute Resolution and on the Advisory Board for the National Workplace Bullying Coalition, which is working to pass legislation to recognise bullying in the workplace as a toxic epidemic and create accountability. In this series, we examined a range of questions on the abovementioned subject. Specifically, we analysed the efficacy of Appropriate/Alternative Dispute Resolution (ADR) in combatting workplace bullying, discrimination, and harassment while examining the most suitable processes for safeguarding employees from such offences. We explored laws /employers’ legal obligations that are in place to prevent and address such behaviours while examining the encouragement of reporting such incidents through ADR.
Furthermore, we highlighted the common obstacles that impede employees from reporting, such as fear of retaliation from the organization or employer. Lastly, Hershey shared her personal experience with bullying, discrimination, and harassment, shedding light on cultural nuances that aid and abet these issues, including language barriers, education, hair, and proximity to whiteness, among others.
